PART I: TERMS OF SERVICE
Article 1. Definitions
1.1 "Agreement" refers to these Terms of Service, including all incorporated disclaimers and the Privacy Policy.
1.2 "Course" refers to the digital educational materials provided by Harmony Works LLC through this website.
1.3 "User" or "you" refers to any individual accessing or using the Course, including parents or guardians supervising teen drivers.
1.4 "Company," "we," "us," or "our" refers to Harmony Works LLC, an Ohio limited liability company.
1.5 "Platform" refers to the website and any third-party services used in conjunction with the Course, including but not limited to Thinkific, Stripe, and PayPal.
1.6 "Personal Information" means any information that relates to an identified or identifiable individual.
Article 2. License Grant & Restrictions
2.1 License Grant. Subject to compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Course for personal, non-commercial purposes.
2.2 License Restrictions. You shall not: (a) Copy, modify, or distribute any part of the Course; (b) Use the Course for any commercial purpose or for the benefit of any third party; (c) Reverse engineer, decompile, or otherwise attempt to derive the source code of the Course; (d) Remove, alter, or obscure any proprietary notices on the Course.
Article 3. Account & Security
3.1 Account Creation. You may be required to create an account to access the Course. You agree to provide accurate and complete information during registration and to update such information as necessary.
3.2 Security Obligations. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
3.3 Household Use Rules. The Course is intended for use by you and members of your household only. You agree not to share your login information with individuals outside your household.
Article 4. Payment Terms
4.1 Payment Terms. All fees for the Course must be paid in advance. We accept payments through Stripe and PayPal.
4.2 Refunds. Refunds may be granted at our sole discretion and are subject to our refund policy.
4.3 Chargebacks. You agree not to initiate any chargebacks without first attempting to resolve the issue with us directly.
4.4 Taxes. You are responsible for any taxes applicable to your purchase of the Course, excluding taxes based on our income.
Article 5. Intellectual Property
5.1 Intellectual Property Ownership. All content and materials within the Course are owned by or licensed to us and are protected by intellectual property laws.
5.2 DMCA Notice. If you believe that any content on the Platform infringes your copyright, please notify us in accordance with the Digital Millennium Copyright Act (DMCA).
5.3 Usage Restrictions. You agree not to use the Course in any manner that infringes on our intellectual property rights or those of any third party.
Article 6. Third-Party Services
6.1 Integration. The Platform may integrate with third-party services such as Thinkific, Stripe, PayPal, and analytics tools. Your use of these services is subject to their respective terms and policies.
Article 7. User Conduct
7.1 Prohibited Conduct. You agree not to engage in any conduct that: (a) Violates any applicable law or regulation; (b) Is fraudulent, misleading, or deceptive; (c) Is harmful, threatening, or abusive.
Article 8. Disclaimers of Warranties
8.1 General Disclaimer. The Course is provided "as is" without any warranties of any kind, whether express or implied. See Part II for additional disclaimers specific to the Course content.
Article 9. Limitation of Liability
9.1 Limitation. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Course or any activities undertaken while applying concepts learned from the Course.
Article 10. Indemnification
10.1 Indemnity. You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, or expenses arising from your use of the Course, including any claims arising from driving activities you supervise.
Article 11. Dispute Resolution
11.1 Arbitration. Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11.2 Class-Action Waiver. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
11.3 Governing Law. This Agreement shall be governed by the laws of the State of Ohio.
11.4 Venue. Any legal action or proceeding shall be brought in the courts located in Delaware, Ohio.
Article 12. General Provisions
12.1 Severability. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
12.2 Assignment. You may not assign your rights or obligations under this Agreement without our prior written consent.
12.3 Waiver. No waiver of any breach of this Agreement shall be deemed a waiver of any subsequent breach.
12.4 Notices. Notices under this Agreement shall be sent by email to [email protected] and are deemed received 24 hours after sending.
12.5 Modification of Terms. We reserve the right to modify these Terms at any time. Continued use of the Course constitutes acceptance of the revised Terms.
12.6 Termination. We may terminate your access to the Course at any time, with or without cause. You may terminate this Agreement by ceasing to use the Course.
12.7 Survival. Provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, arbitration, and governing law shall survive termination of this Agreement.
12.8 Entire Agreement. This Agreement, including Parts I, II, and III, constitutes the entire agreement between you and us regarding the use of the Course and supersedes any prior agreements or understandings.
PART II: COURSE DISCLAIMERS & ACKNOWLEDGMENTS
Article 13. Educational Purpose
13.1 Educational-Only Purpose. The Course is designed solely for educational purposes. It aims to provide parents with structured techniques and neuroscience-based communication strategies to effectively coach their teens in driving. The Course does not provide direct instruction to teens and is not a substitute for professional driver education.
13.2 Neuroscience Information. The neuroscience and brain development information provided in this Course is for educational context only and does not constitute medical, psychological, or clinical advice. Consult qualified professionals for concerns about your teen's cognitive or psychological development.
Article 14. Not State-Certified Driver Education
14.1 No State Certification. This Course is not certified by any state as an official driver education program. It is intended to complement your efforts as a parent in teaching your teen to drive, but it does not replace any state-mandated driver education requirements.
14.2 DMV Requirements. Participation in our Course does not fulfill any Department of Motor Vehicles (DMV) requirements or any school-related driver education requirements. It is your responsibility to ensure compliance with all applicable state and local driving education requirements.
Article 15. No Professional Relationship
15.1 No Certification. The Course is not provided by a certified driving school and does not establish a professional or instructor-client relationship.
15.2 Advisory Only. Our Course does not provide legal, professional, or licensed driving instruction. The content is solely advisory and educational, intended for parental guidance.
15.3 Advisory Materials. The audio, video, and worksheet materials provided in our Course are advisory only. They are designed to support your instruction as a parent, not to replace it.
Article 16. No Guarantee of Results
16.1 No Guarantee. We do not guarantee any specific safety outcomes, results, or accident prevention through the use of our Course materials. Driving inherently involves risks that cannot be entirely eliminated.
16.2 Skill Progression. The skill progression timelines, hour ranges, and developmental stages presented in this Course are general pedagogical guidelines based on typical learning patterns. Individual results vary significantly based on practice frequency, teen readiness, and other factors. These timelines do not guarantee any specific rate of skill acquisition.
Article 17. Assumption of Risk
17.1 Inherent Risks. You acknowledge that teen driving is inherently dangerous and that you assume all risks associated with supervising a teen driver, including but not limited to vehicular accidents, personal injury, property damage, and environmental hazards.
Article 18. User Responsibilities
18.1 Assessing Teen Readiness. It is your responsibility to assess whether your teen is ready to begin driving, taking into account their maturity, ability, and understanding of driving principles.
18.2 Supervising All Driving. You are solely responsible for supervising your teen during all driving activities. Our Course does not provide any in-person supervision or observation.
18.3 Compliance with Laws. You must ensure compliance with all applicable state and local driving laws and regulations during your teen's driving practice.
18.4 Environmental Risks. You are responsible for assessing and managing all environmental, vehicle, and weather-related risks during driving practice.
Article 19. No Reliance Clause
19.1 No Reliance. You acknowledge that you are not relying on any statements, promises, or representations made by us outside of this Agreement. Your decision to use this Course is based solely on the terms outlined herein.
PART III: PRIVACY POLICY

20.1 This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our website and use our services.
